In California, submetering is regulated by the Department of Agriculture/Weights and Measures and requires the following:
A commercial measuring device (i.e. meters for a submetering system) may only be installed by a county sealer or a registered service agency. Delta Utility Solutions is a registered service agency. Any person employed by a service agency must have a current service agent license. All Delta installers are licensed service agents.
Prior to being used for commercial purposes the meters must meet certain requirements. A meter must be type-approved by the Department of Food and Agriculture. All meters must be inspected and sealed by the county sealer, prior to installation.
Charging tenants for cold water based on only their hot water measurements is an unacceptable practice under weights and measurements requirements.
No water submeter is approved for hot water use in California. The commercial use of an unapproved device or the use of an approved device in an application unsuited to its type is prohibited by California law. Under these circumstances, these devices cannot be used to charge tenants for the water that passes through them. These devices may however, be installed and used in a noncommercial way to give an indication of over usage or faulty plumbing.
All meters installed must be registered and the owner must pay the appropriate annual device registration fee. This fee is determined per location and the number of applicable submeters at that location.
Another regulation that may apply is the Safe Drinking Water Act (SDWA): How is each state (and in some cases a local branch of a state agency) implementing the provisions of this federal law? Some states require owners to employ a water-testing program.
